URA SECURES URGENT VICTORY IN GAUTENG HIGH COURT

In Mupfunguri v Comit Capital (Pty) Ltd (case number: 2026-176298), the Applicant sought urgent relief compelling our client to reinstate a terminated funded trading account and process a disputed payout request. The relief would effectively have required our client to continue performing under a disputed commercial agreement before the contractual dispute had been properly ventilated.

The application was brought on severely truncated time periods, leaving URA effectively two court days to prepare answering papers.

URA’s Director, @jp_venter and Associate, @bongx_r diligently drafted the required pleadings, setting out our client’s position and pointing out the flaws in the Applicant’s case.

On 31 July 2026, the High Court ruled that the Applicant had clearly abused court processes and should never have approached the urgent High Court with a case which was flawed in law. The application was accordingly struck from the urgent roll for lack of urgency, with costs granted in our clients favour.

URA SECURES SUBSTANTIAL COMPENSATION IN CCMA CASE

In a pro bono matter, URA represented a custodian, formerly employed by a prominent Sandton school.

Our client had reported to management and other personnel that she had been a victim of inappropriate conduct which had been taking place for an extensive period of time, and that such conduct had been at the hands of her superior. Within days, our client was invited to a meeting and asked to substantiate her allegations, while in the presence of her perpetrator.

Without conducting any further investigations, the perpetrator was found not guilty of the reported allegations. Pursuant to this, our client was notified to attend a disciplinary hearing. At the disciplinary hearing, our client was denied her request to be represented by a colleague despite there being a clear language barrier, and was immediately informed by a senior member of management that she was found guilty of several spurious charges and accordingly dismissed. Our client was unfairly deprived of the opportunity to make substantial representations to any of the charges.

The school failed to conduct a thorough investigation and had failed to conduct a procedurally fair disciplinary hearing, which resulted in a predetermined outcome.

URA’s Senior Associate @gerijayde and Candidate Attorney @j.thurston_ vigorously defended our client, leading to a successful outcome wholly in her favour. The outcome included securing near-maximum statutory compensation for unfair dismissal, with additional terms to ensure she is well-positioned to seek further employment.

This is a victory not only for our client but for employees who are unfairly dismissed without due process, especially in circumstances where they are the victim and bear the brunt for raising the alarm. This serves as a clear reminder that employers will be held accountable for procedurally unfair and unjust conduct.

Our client, who is in possession of a valid employment visa, was arrested and detained, subsequent to the Department of Home Affairs control system claiming that she was illegally entering South Africa.

The National Prosecuting Authority opposed our client’s release on bail, insisting that she was an illegal immigrant and should accordingly be detained until finalisation of her trial.

URA’s @ulrichroux and @brady_wolmarans immediately conducted investigations, scrutinised the Immigration Act of South Africa, and ultimately furnished the Court with sufficient evidence of possible corruption within Home Affairs and pertaining to certain individuals within the Department.

URA successfully convinced the Court that our client had in fact not defrauded Home Affairs, in the process securing her release on bail in the Kempton Park Magistrates’s Court.

South Africa is currently faced with great uncertainty pertaining to foreign nationals residing within our borders. In order to ensure that illegal foreigners either leave the country, or rectify their status, we must have a functioning and corrupt-free Department of Home Affairs. This matter highlights the importance of an effective State Department, ensuring that law-abiding individuals are not arrested or prosecuted unlawfully.

URA SECURES FATHER’S RIGHT TO UNSUPERVISED CONTACT AND SUCCESSFULLY OBTAINS CONTEMPT ORDER

URA’s @stormroux_, together with @clarissescheepers, @carle_kriedemann and Counsel obtained a successful outcome for our client, an unmarried father in proceedings concerning contact with his 22-month-old son.

The matter arose after the mother unilaterally sought to restrict the father’s Court Ordered contact and insisted that contact be supervised. The father had agreed to a period of supervised contact on an interim basis. Thereafter, he insisted on the enforcement of the existing Court Orders after extensive supervision by social workers confirmed him to be a capable and loving parent.

Following urgent proceedings in the Johannesburg High Court (and the mother’s urgent counter variation application), the Court reaffirmed the father’s right to unsupervised contact and directed the mother to comply with the existing contact regime.

In a strongly worded judgment, the Court held: “The proper functioning of the judicial system depends on the foundational principle that court orders must be obeyed until they are set aside by a competent court. To hold otherwise would invite chaos and encourage litigants to resort to self-help, a course of action that our courts have repeatedly condemned.”

The Court found the mother in contempt of Court, reinstated the father’s unsupervised contact with immediate effect, sentenced the mother to 30 days’ imprisonment wholly suspended for 36 months, and ordered her to pay the father’s legal costs for both the urgent and counter application.

This matter serves as an important reminder that neither parent may unilaterally disregard or interfere with a child’s relationship with the other parent when both parties hold equal rights and responsibilities and especially where contact is regulated by a Court Order. The judgment reaffirms that the best interests of children remain paramount and solidifies the importance of the meaningful involvement of both parents in a child’s life.

URA SECURES SUCCESSFUL ORDER IN HIGH COURT PROPERTY DISPUTE

URA’s @stormroux_ and Candidate Attorney @kiara_bahadur_ successfully obtained a High Court order compelling the transfer of immovable property to our client after the sellers refused to honour a valid agreement of sale.

The matter concerned the purchase of a property in Cape Town, in respect of which our client had fully complied with her obligations under the agreement by paying the deposit, securing bond finance and attending to the transfer costs. Despite this, the sellers sought to avoid their contractual obligations and refused to sign the transfer documentation.

An order for specific performance was granted, directing the sellers to sign all documents necessary to transfer the property to our client. The Court further authorised the Sheriff to sign the transfer documentation on the sellers’ behalf should they fail and/or refuse to do so within the prescribed period. The sellers were also ordered to provide vacant occupation of the property and to pay our client’s costs.

In a carefully reasoned judgment, the Court reaffirmed the importance of contractual certainty and the principle of pacta sunt servanda (that agreements freely and voluntarily concluded should be honoured). Significantly, the Court held:
“The respondents clearly developed ‘seller’s remorse’ after the fact.”

This judgment serves as an important reminder that parties who enter into binding agreements cannot simply walk away from their obligations when circumstances become inconvenient.
