Last week, our @stormroux_ and @clariesvermaak had the privilege of attending Clarks Attorneys’ 12th Annual Johannesburg Family Law Conference.

The two-day event offered a wealth of valuable insights and meaningful engagement with colleagues in the family law sphere. The connections shared throughout the conference reaffirmed the collaborative spirit of the family law community.

It was also encouraging to note that the majority of attendees were women, which we believe to be a testament to the growing representation and leadership of women in the legal profession.

A big thank you to all the speakers for sharing their expertise and to the Clarks Attorneys team for hosting an excellent conference.

URA SECURES FINAL INTERDICT IN DEFAMATION MATTER

Our client, a popular nationwide restaurant chain, faced defamatory allegations of fraud and misrepresentation made by a member of the public which stood to cause serious reputational harm to our client.

In November 2024, URA successfully brought an urgent ex parte application for an interim interdict to prevent the defaming party from releasing false and defamatory statements to the public.

During October 2025, our @ulrichroux, @camphillips18 and @clarissescheepers successfully obtained a final order against the defaming party, interdicting him from, among others, publishing defamatory content pertaining to our client’s business and publishing any statements calling for the boycott of our client’s business. In addition, the Judge hearing the matter awarded a punitive cost in favour of our client.

The final interdict serves to protect our client’s business interests. Should the defaming party contravene such an order, he risks further contempt of court proceedings and possible jail time.

This matter is but one of many urgent applications URA has expertly launched and obtained the final order to protect our clients’ fiduciary and business interests.

According to the 2019 National Cancer Registry, breast cancer is one of the most common cancers in South African women, and while rare, male breast cancer counts for 1% of all breast cancers in South Africa.

URA is supporting @thepinkdrive and @iloveboobies_za (thanks to @mond_vol) this month.

We were lucky enough to have the PinkDrive truck at our offices today! Our URA ladies had clinical breast exams (breast cancer screening which included one-on-one cancer education) done. Our men had prostate specific antigen tests (PSA) (rapid testing, administered by a simple finger prick) done.

ANOTHER VICTORY FOR URA IN THE URGENT JHB HIGH COURT

@stormroux_ alongside Candidate Attorney @clarissescheepers secured the rights of our client (the father) to exercise unsupervised contact with his 1-year-old son, despite the mother’s persistent interference, pending the finalisation of a forensic report by the appointed clinical psychologist.

The matter was heard on an urgent basis in the JHB High Court after our client arrived to exercise contact with his son and the mother refused to hand over the minor child.

During the hearing, the Court heard evidence confirming that the mother was consistently interfering with the time our client was allowed with his son, with the mother inter alia using the domestic worker/nanny to spy on and report back on our client’s contact with his child.

The Court agreed with our submissions, finding that the mother was unjustifiably interfering with our client’s contact with his son, with the Judge confirming as follows:

“There are no facts before me that the father is incompetent to parent his child. Whatever “rumblings” are before this Court, suggest that the mother simply needs to be in control and has difficulty in allowing the minor child to bond with his father.”

The Court made an order which allows our client to exercise contact without supervision, with immediate effect. The mother has also been “prohibited from in any way interfering with the time that the minor child spends with his father, nor is she to use any other persons to interfere with the contact periods permitted in the order”.

The mother was furthermore ordered to pay our clients’ legal costs.

This matter is yet another example of our team’s commitment to fighting for parental rights and ensuring that the best interests of minor children remain paramount.

URA SECURES FAVOURABLE ORDER FOR REPAYMENT OF LEGAL DEPOSIT, INTEREST AND COSTS

An attorney practicing as a “consultant” requested a deposit from our clients, in respect of anticipated legal costs which he alleged they were likely to incur in their matter. They accordingly paid the requested deposit in the amount of R550 000.

Thereafter, the attorney consistently requested our clients make payment of certain disbursements, notwithstanding the R550 000 they had already made payment of.

After it came to light that he had used the money for his own personal benefit and in 2024, @clariesvermaak and @bongx_r were duly instructed on the matter and demanded repayment of the R550 000 from the attorney without delay.

The attorney acknowledged his indebtedness to our client after which, and as a result of there having been no dispute of fact, URA launched an application to obtain, inter alia, the repayment of the amount.

URA obtained a favorable outcome for our client in the JHB High Court for the repayment of the full amount, interest as well as costs on an attorney-client scale.

URA SECURES FATHER’S RIGHTS IN CAPE TOWN URGENT HIGH COURT

On Friday, 8 August 2025 @stormroux_ alongside Candidate Attorney, @clarissescheepers obtained judgment in an urgent application heard on the evening of Monday, 4 August 2025 in the Cape Town High Court.

We launched an Urgent Application on Saturday, 2 August 2025 to restore our client’s contact with his two minor children, aged 5 and 8.

Amidst the parties’ divorce proceedings, the mother unilaterally and unlawfully decided that our client, the biological father, would go from sharing 50/50 contact to the minor children, to only seeing them every alternative weekend.

Notwithstanding numerous warnings to the mother and her attorneys, she persisted with her unlawful conduct, refusing to hand the minor children over to our client, as per the agreed contact schedule.

URA successfully secured an order restoring 50/50 contact with his minor children and solidifying our client’s parental rights and responsibilities.

In handing down judgement, the Court reaffirmed the need to have regard to the rights and responsibilities of both fathers and mothers to their children and the important role which fathers play in minor children’s lives.

During National Women’s Day week, we acknowledge and commend our formidable female attorneys and the impact they have in progressing the legal industry and, in this instance, protecting father’s rights to their minor children.

In two separate matters heard in the JHB High Court this week, URA’s Storm Roux, alongside Clarisse Scheepers, and Clarisa Vermaak, alongside Kiara Bahadur, successfully secured care and contact rights for fathers of their minor children.

As upper guardian, the High Court is the sole authority pertaining to what is in a minor child’s best interest.

In both these High Court matters, the fathers of the minor children had been alienated, with the respective mothers refusing adequate and fair contact between the fathers and their children. URA successfully restored adequate contact, subject to forensic assessments being conducted in order to ultimately determine what will be in the best interest of the minor children.

The Children’s Act gives effect to, inter alia, certain rights of children as contained in the Constitution, the rights and responsibilities as related to children and further sets out principles relating to the care and protection of children.

Parents are reminded that personal conflict should never override a minor child’s right to maintain a healthy relationship with both parents.

URA SUCCESSFULLY FREEZES PROPERTY PLEDGED AS SECURITY FOR LOAN

Our client, a UAE based company and a non-profit operating out of KwaZulu-Natal, entered into a loan agreement with a family trust where an amount was loaned to the trust for the purchase of a property.

As security for the loan, the trust pledged a property which it alleged it owned.

Upon calling up the security, what transpired was that the trust was not the lawful nor registered owner of the property. The property was instead owned by a company controlled by the trustees of the trust.

In a highly contested application involving complex issues of trust and contractual law, URA’s @camphillips18 and @_juneen_ successfully obtained an interdict to preserve the property pending the outcome of action proceedings launched for the recovery of the loan amount.

The High Court, in addition to granting the interdict sought, awarded costs to our clients.

This matter demonstrates that any such misrepresentation committed in relation to a contract can result in parties who contract in good faith obtaining relief against those intent on causing harm.

URA FINALISES 4 YEAR ACRIMONIOUS DIVORCE WITHIN 3 MONTHS OF BEING APPOINTED

Having instituted divorce proceedings in the beginning of 2021, our client appointed us in August 2024 to finalise his divorce. He did so in desperation, after three previous sets of attorneys could not successfully assist him.

The divorce was focused primarily on an estate valued at approximately R600million and what would be the most reasonable and fair way of dividing same, allowing our client and his ex-wife to go their separate ways. With multiple juristic entities involved, URA’s @ulrichroux and @mg_temlett were tasked with dissecting the respective entities, strategically applied the provisions of the Companies Act and made use of international trust and company laws to successfully protect our client’s interests.

Three months after being appointed, subsequent to extensive strategic settlement discussions, our client signed a settlement agreement which was legally sound, fair and protected his interests. This brought his 4-year acrimonious divorce to an end, allowing our client to focus on moving on with his life.

Divorce isn’t just about separation, it’s about redefining stability, ensuring fairness and carving out a future with clarity. Every case tells a different story, but the goal remains the same: securing a fair resolution that allows both parties to move forward.

ALLEGATIONS MOUNT AGAINST MURDER-ACCUSED HEADACHE SPECIALIST DR ELLIOT SHEVEL

URA’s Storm Roux and Clarisse Scheepers act for the latest patient brave enough to come forward and speak out against South African headache specialist Dr Elliot Shevel. The Headache Clinic owner has been charged with the murder of former patient Marinella Avvakoumides, who died hours after undergoing a procedure at his clinic in 2021.

In September 2024 the Health Professions Council of South Africa (HPCSA) suspended Shevel after receiving numerous complaints of reckless malpractice.

Two of those complaints involve patients who died after undergoing his procedure.

Another involves Bruce Johnstone, a single father of three, who has been left in a vegetative state after being treated by Dr Shevel in 2022.

@news24 reported on our client’s harrowing experience after having survived five procedures under the hands of Dr Shevel.

Our client attempted to secure justice for her ordeal in 2016, 2018 and 2019 by reporting the Doctor to the HPCSA, but to no avail. The HPCSA dismissed our client’s complaint, simply confirming that “the explanation of Dr Shevel is accepted” and “the complaint falls outside the Council’s jurisdiction”.

Our client is not interested in revenge, she is focused on ensuring that no more people suffer as a result of Dr Shevel’s reckless actions.

Our client confirms: “I’m sad and disappointed that people had to lose their lives for something to be done. He impacted my physical health and my ability to trust people. I’m surprised I’m not dead.”

URA INTERDICTS TSHWANE MUNICIPALITY FROM UNLAWFULLY DISCONNECTING POWER TO COMMERCIAL PROPERTY

Our client is the owner and operator of a commercial property in Pretoria and is involved in a protracted dispute with the Tshwane Municipality pertaining to the previous owner’s problematic electricity account.

Without warning, the Municipality proceeded to unlawfully disconnect the electricity supply, causing extensive financial loss to our client.

URA’s Cameron Phillips and Clarisse Scheepers successfully interdicted the municipality in the Urgent High Court in Pretoria, ensuring that the power is reconnected and interdicting the municipality from unlawfully disconnecting our client’s power again.

The High Court in addition ordered the municipality to pay our client’s legal fees on a punitive scale.

South Africans are regularly faced with unlawful threats from their respective municipalities that their power is going to be disconnected.

URA SECURES SAFETY OF MINOR CHILDREN AFTER MOTHER’S UNEXPECTED PASSING

The mother and primary caregiver of two minor children unexpectedly passed away, leaving the distraught children without certainty as to who would take care of them.

The children’s father, who had last seen his children three months prior to their mother’s passing, and who, by court order, was only allowed to exercise supervised contact with his children, threatened to remove the children from their mother’s home and force them to reside with him.

In an urgent application in the JHB High Court, URA’s @ulrichroux and @mg_temlett were successful in securing the safety of the minor children, with the court ordering that they are to reside with their maternal grandmother, with the father of the children allowed supervised contact with the children on a limited basis.

The High Court of South Africa is the upper guardian of all minor children, with the best interest of minor children superseding the rights of any other parties, including the biological parents.

In determining what is in the best interest of minor children, the court takes all relevant factors into consideration and is guided by the provisions of the Children’s Act 38 of 2005.

The lawyers in the family law department at URA are well-versed with all applicable family law legislation and skilled and experienced in the Family Court, Children’s Court, Domestic Violence and Maintenance Court, ensuring that our client’s mandate is at all times carried out with skill and dedication and that the best interest of minor children always remain paramount.

URA SECURES CONVICTION ON BEHALF OF CLIENT IN 4-YEAR COURT BATTLE

URA acts on behalf of the complainant in a criminal case where our client, a female, was viciously and unlawfully assaulted by her neighbour.

After having initially laid the criminal charges herself, our client was informed by the NPA that they would not be pursuing the prosecution against the accused.

URA’s Geraldean Dawes reconstructed the docket, assisted the South African Police with obtaining the relevant incriminating evidence, and, together with the NPA, successfully enrolled the matter in court again, charging the accused with assault.

The accused pleaded not guilty and did everything within his power to obstruct, unnecessarily prolong and delay the matter. Despite this, he was convicted in the Randburg Magistrates’ Court and will be sentenced accordingly.

At URA we have achieved great success over the years in assisting the South African Police Services and the NPA in the capacity of a watching brief and securing convictions where our clients are complainants in criminal matters.
