URA SUCCESSFULLY FREEZES PROPERTY PLEDGED AS SECURITY FOR LOAN

Our client, a UAE based company and a non-profit operating out of KwaZulu-Natal, entered into a loan agreement with a family trust where an amount was loaned to the trust for the purchase of a property.

As security for the loan, the trust pledged a property which it alleged it owned.

Upon calling up the security, what transpired was that the trust was not the lawful nor registered owner of the property. The property was instead owned by a company controlled by the trustees of the trust.

In a highly contested application involving complex issues of trust and contractual law, URA’s @camphillips18 and @_juneen_ successfully obtained an interdict to preserve the property pending the outcome of action proceedings launched for the recovery of the loan amount.

The High Court, in addition to granting the interdict sought, awarded costs to our clients.

This matter demonstrates that any such misrepresentation committed in relation to a contract can result in parties who contract in good faith obtaining relief against those intent on causing harm.

URA FINALISES 4 YEAR ACRIMONIOUS DIVORCE WITHIN 3 MONTHS OF BEING APPOINTED

Having instituted divorce proceedings in the beginning of 2021, our client appointed us in August 2024 to finalise his divorce. He did so in desperation, after three previous sets of attorneys could not successfully assist him.

The divorce was focused primarily on an estate valued at approximately R600million and what would be the most reasonable and fair way of dividing same, allowing our client and his ex-wife to go their separate ways. With multiple juristic entities involved, URA’s @ulrichroux and @mg_temlett were tasked with dissecting the respective entities, strategically applied the provisions of the Companies Act and made use of international trust and company laws to successfully protect our client’s interests.

Three months after being appointed, subsequent to extensive strategic settlement discussions, our client signed a settlement agreement which was legally sound, fair and protected his interests. This brought his 4-year acrimonious divorce to an end, allowing our client to focus on moving on with his life.

Divorce isn’t just about separation, it’s about redefining stability, ensuring fairness and carving out a future with clarity. Every case tells a different story, but the goal remains the same: securing a fair resolution that allows both parties to move forward.

ALLEGATIONS MOUNT AGAINST MURDER-ACCUSED HEADACHE SPECIALIST DR ELLIOT SHEVEL

URA’s Storm Roux and Clarisse Scheepers act for the latest patient brave enough to come forward and speak out against South African headache specialist Dr Elliot Shevel. The Headache Clinic owner has been charged with the murder of former patient Marinella Avvakoumides, who died hours after undergoing a procedure at his clinic in 2021.

In September 2024 the Health Professions Council of South Africa (HPCSA) suspended Shevel after receiving numerous complaints of reckless malpractice.

Two of those complaints involve patients who died after undergoing his procedure.

Another involves Bruce Johnstone, a single father of three, who has been left in a vegetative state after being treated by Dr Shevel in 2022.

@news24 reported on our client’s harrowing experience after having survived five procedures under the hands of Dr Shevel.

Our client attempted to secure justice for her ordeal in 2016, 2018 and 2019 by reporting the Doctor to the HPCSA, but to no avail. The HPCSA dismissed our client’s complaint, simply confirming that “the explanation of Dr Shevel is accepted” and “the complaint falls outside the Council’s jurisdiction”.

Our client is not interested in revenge, she is focused on ensuring that no more people suffer as a result of Dr Shevel’s reckless actions.

Our client confirms: “I’m sad and disappointed that people had to lose their lives for something to be done. He impacted my physical health and my ability to trust people. I’m surprised I’m not dead.”

URA’s @clariesvermaak and @bongx_r was approached by a client who was married in community of property and who was stuck in a 12 year long divorce process which was tactfully delayed by the opposing attorneys.

Our client was desperate for his matter to be brought to finality. Clarisa and Bongiwe did not entertain attempted delays from the opposing party and ensured that the divorce proceeded with the necessary care and urgency.

Our client is the owner and operator of a commercial property in Pretoria and is involved in a protracted dispute with the Tshwane Municipality pertaining to the previous owner’s problematic electricity account.

URA SECURES SAFETY OF MINOR CHILDREN AFTER MOTHER’S UNEXPECTED PASSING

The mother and primary caregiver of two minor children unexpectedly passed away, leaving the distraught children without certainty as to who would take care of them.

The children’s father, who had last seen his children three months prior to their mother’s passing, and who, by court order, was only allowed to exercise supervised contact with his children, threatened to remove the children from their mother’s home and force them to reside with him.

In an urgent application in the JHB High Court, URA’s @ulrichroux and @mg_temlett were successful in securing the safety of the minor children, with the court ordering that they are to reside with their maternal grandmother, with the father of the children allowed supervised contact with the children on a limited basis.

The High Court of South Africa is the upper guardian of all minor children, with the best interest of minor children superseding the rights of any other parties, including the biological parents.

In determining what is in the best interest of minor children, the court takes all relevant factors into consideration and is guided by the provisions of the Children’s Act 38 of 2005.

URA SECURES CONVICTION ON BEHALF OF CLIENT IN 4-YEAR COURT BATTLE

URA acts on behalf of the complainant in a criminal case where our client, a female, was viciously and unlawfully assaulted by her neighbour.

After having initially laid the criminal charges herself, our client was informed by the NPA that they would not be pursuing the prosecution against the accused.

URA’s Geraldean Dawes reconstructed the docket, assisted the South African Police with obtaining the relevant incriminating evidence, and, together with the NPA, successfully enrolled the matter in court again, charging the accused with assault.

The accused pleaded not guilty and did everything within his power to obstruct, unnecessarily prolong and delay the matter. Despite this, he was convicted in the Randburg Magistrates’ Court and will be sentenced accordingly.

At URA we have achieved great success over the years in assisting the South African Police Services and the NPA in the capacity of a watching brief and securing convictions where our clients are complainants in criminal matters.

URA’s Bongiwe Radebe (@bongx_r ) represents a victim of grievous sexual assault, with our client being a minor at the time when the crime was committed.

The sexual offender was convicted and sentenced to a period of imprisonment. Subsequent to being released from jail, the convicted sexual predator wrote a book in which he falsely claimed his innocence and criticised the SA Judicial System.

We successfully interdicted the distribution and selling of the book, protecting our client’s rights to privacy and defamation. We also secured a punitive costs order on behalf of our client.

Upon obtaining a writ of execution, whereby the Sheriff of the High Court attached the felon’s private property, to be sold on auction, our opponent launched an urgent application to set aside the High Court interdict, as well as the writ of execution.

The urgent High Court application was struck from the JHB High Court’s roll, with costs once again being awarded in favour of our client.

Our client’s rights remain protected and justice has been served.

Another successful outcome for the URA Cape Town branch!

A commercial matter with a quantified amount of approximately R15 million that has been ensuing in the Cape Town High Court since 2021, has finally reached a conclusion, with a favourable outcome being secured for our client by Storm Barry, head of our Cape Town branch.

An application was brought against our client in her personal capacity on the basis of a loan agreement governed by the laws of another country, Mauritius. Coupled with this issue, was a claim for extremely high interest. This falls under the legal concept called “usury” which refers to the practice of charging an exorbitant, illegal rate of interest on a loan.

Our client has been at the hands of frivolous and vexatious litigation, which is defined as legal action that is brought in an attempt to intimidate and/or subdue an adversary.

Resolution was reached between the disputing parties, albeit long after the court action commenced and the matter was accordingly withdrawn by the Plaintiff and an agreement as to costs was reached between the parties.

Our attorneys are experienced, professional and are strong advocates for mediation and settlement of matters in order to assist in avoiding unnecessary legal costs.

URA SECURES RESOUNDING VICTORY ON BEHALF OF PROMINENT SOUTH AFRICAN INSURANCE COMPANY

Appearing in the Specialised Commercial Crimes Court in Gauteng, our client, a market leading South African insurance company, faced criminal charges of having infringed the Copyright Act 98 of 1978. It was alleged that our client sold a product which was created by another company.

Our client was represented by Director @ulrichroux and Associate @mg_temlett.

Having heard the testimony of four witnesses called by the State, with the matter being in court for three years, the Court granted our Section 174 discharge application, confirming that there was no case for our client to answer to, handing down an emphatic verdict of not guilty.

The court was clear in finding that the State had not come close to making out a proper case for our client to answer to and warned against the manufacturing of criminal charges for commercial gain.

Our client will now be instituting a damages claim for malicious prosecution against the State, seeking compensation for legal expenses incurred in having to defend the frivolous charges levelled against them by the State.

The High Court ruled that the mother has alienated the boys to such an extent from the father, that it constitutes psychological abuse of the minor children. The court was guided by a number of forensic experts who psychologically assessed the boys and their respective parents.

In addition to ruling that the mother severely traumatised the young boys, she was also found by the Court to have used the boys as accessories to criminally record their contact sessions with their father, an act that cemented the High Court’s decisive ruling to remove the boys from her care.

The boys are currently undergoing intensive trauma therapy and an interim contact regime with both their parents will be implemented in due course, once deemed appropriate and in line with a treatment plan to cure the alienation.

The High Court is the upper guardian of all minor children, and will always place the best interests of the children above the parents.

Parents of minor children should never let their own disliking of the other parent negatively effect their kids and should instead focus on effective co-parenting, in accordance with the rights and responsibilities of both parents, as set out in our Children’s Act.

URA is acting pro bono on behalf of two of the victims of the barbaric and unlawful assault by Deputy President Paul Mashatile’s VIP Protection Unit on the N1 highway in Jhb.

We will ensure that the police officers who assaulted our clients are held accountable for their senseless behaviour and will be assisting the NPA to prosecute the police officers in ensuring that justice prevails for our clients.

URA is acting pro bono on behalf of two of the victims of the barbaric and unlawful assault by Deputy President Paul Mashatile’s VIP Protection Unit on the N1 highway in Jhb.

We will ensure that the police officers who assaulted our clients are held accountable for their senseless behaviour and will be assisting the NPA to prosecute the police officers in ensuring that justice prevails for our clients.

URA SECURES INTERIM INTERDICT AGAINST PUBLISHING OF CLIENT’S STOLEN DOCUMENTS

URA’s @ulrichroux , @vanessa_fernihough and @mg_temlett recently obtained an interim interdict in the JHB High Court, preventing a well-known investigative journalism outfit from publishing intellectual property which was stolen from our client by a disgruntled former employee.

Criminal charges were laid against the former employee during November 2022 and the SAPS is in the process of finalising their investigation.

Whilst we support and encourage freedom of the press, we do not support journalists making use of and relying on criminal actions in order to publish confidential personal and commercial information which belongs to our client.

It has been verified that more than 4000 documents were stolen from our client’s internal server, with the former employee unlawfully gaining access thereto prior to resigning during October 2022. The documents were then maliciously handed over to the media in an attempt to cause financial and commercial harm to our client.

All members of society must act within the confines of the law and no exceptions should be made, regardless of a person’s profession.

Mr Joel Letwaba made defamatory remarks towards the deputy president on national television during October 2021, forcing our client to approach the High Court for interdictory and ancillary relief.

In a scathing judgement handed down by Judge Mashile, Mr Letwaba has been interdicted from making any further defamatory remarks towards our client and has further been ordered to make public apologies towards our client on news channels @enca and @newz405. Said apologies must be made within 14 days of the order.

Letwaba has further been ordered to pay our client’s costs on an attorney and client scale, including costs of two counsel.

South Africans are reminded by this judgement that our courts take a dim view of defamatory remarks being made towards any other citizen, on any social media or other public platform.

Any remarks made towards another person or entity on a public platform must be in the public interest and must be found to be truthful, failing which it will be regarded by our courts as being unlawful.

Oscar Pistorius will appear before the Parole Board on 31 March 2023 for his application to be released from prison. Pistorius has served half of his 15 year prison sentence for murdering his girlfriend Reeva Steenkamp in 2013.

Upon considering the evidence presented during the hearing, the parole board will only release Pistorius in the event that they find the following:

1. He is no longer a danger to society.
2. He has successfully been rehabilitated in prison.
3. He actively took part in the various education and life skills classes presented in prison.
4. His behaviour in prison was commendable.

The seriousness of the crime, as well as the impact which the crime had on society, specifically Steenkamp’s parents, family and dependants, will also be considered in great detail.

Our justice system aims to rehabilitate offenders in order for them to be integrated back into society and positively contribute towards the community at large.

Pistorius will have to show remorse for his crime and convince the parole board that he has successfully been rehabilitated. This will not be an easy task.

Should he be released on parole, conditions such as house arrest and being prevented to use alcohol could be imposed for the remainder of his sentence.

URA’s Casper Badenhorst and Bongiwe Radebe successfully obtained an interdict in the JHB High Court against the publication of a book authored by a convicted sexual predator.

During December 2015, the former principal of a leading private school in JHB, was convicted of sexual assault of URA’s client, a former pupil of the school.

Subsequent to being sentenced to three years imprisonment for sexual assault of a minor, the convicted offender proceeded to author, publish and market a book in which he portrayed an untruthful story of how he had been wrongfully convicted.

In light of the heinous crime committed against our client and the complete manipulation of the truth contained in the book, Justice Mazibuko handed down judgment in which she confirmed that the book infringed our clients’ Constitutional rights to dignity and privacy, that the book’s content was defamatory and that it should not be made available or marketed to purchase by the South African public.

A ground breaking judgement, ensuring that our client does not have to re-live the horror of being sexually assaulted and that his lawful rights remain protected.

A major victory for @stormbarry_ and our Cape Town branch, securing the rights of our client (the mother) to care and contact of her two minor children. The matter was heard in the Cape Town High Court on an urgent basis.

An application was launched against our client regarding contact with the minor children, pending the parties’ divorce.

Our client mandated us to ensure that her parental rights and responsibilities and contact and care concerning her children were protected.

Despite the opposition’s unreasonable demands to file affidavits within five hours of receiving the application, URA successfully obtained an order setting aside the father’s irrational demands and unmeritorious application.

Our client’s rights have been restored and the best interest of the minor children have been protected by the High Court, ensuring that the father’s obstructive behaviour will no longer be allowed.

The much-anticipated legal battle between President Cyril Ramaphosa and Jacob Zuma will be heard by a full bench of three judges in the South Gauteng High Court tomorrow, the 12th of January 2023.

Ramaphosa has launched an urgent application for an interdict against Zuma’s private prosecution of Ramaphosa, which is set to commence on 19 January 2023.

Zuma has already instituted a private prosecution against Advocate Billy Downer and journalist Karyn Maughan and has now, bizarrely, also launched a private prosecution against the President of South Africa, using the same Nolle Prosequi certificate.
